Patent Drafting

A specification from the inventor's material, before anything is filed.

An invention disclosure form, a set of drawings, an inventor's notes. From that, the agent detects the field and the specification type, extracts the inventive concept, and drafts the provisional or complete specification with its claims and abstract, holding claim scope and support in view as the language settles.

Agents in this family
  • Provisional specification. Enough to secure the priority date, written so the complete can be built on it without a gap.
  • Complete specification. Field, background, summary, detailed description, claims and abstract, from the disclosure and inventor input.
  • Provisional to complete. Converts a provisional as filed into the complete, within twelve months, without losing what was disclosed.
  • Claims drafted for scope and support. Independent and dependent claims with antecedent basis checked and every claim supported in the description.
  • PCT national phase. Drafting and adaptation for the Indian national phase from the international application.
  • Invention visualised. A block diagram of the system or a flowchart of the method claim, with every element citing the paragraph it comes from.

Stage 02 · Prosecution
09–16

Patent Examination Responses

The reply to the Controller, built around the statutory grounds.

The examination report is read on its own terms. Each objection is separated and characterised, the cited art is read against the claims, and the response is built ground by ground, with any amendment carried through the claims, the description and the abstract together, so nothing is left inconsistent.

Agents in this family
  • Cited prior-art analyser. Extracts every reference the Controller cited, asks for the documents, and reads each one against the claims feature by feature before a word of the response is drafted.
  • FER Response. The reply to the First Examination Report, objection by objection, within the six-month window under Rule 24B.
  • SER Response. The reply to the Second Examination Report, answering what the Controller maintained.
  • Written Submissions after hearing. The post-hearing submissions, in the firm's format, within the fifteen days that follow.
  • Claim, abstract, description and drawing amendments. Under Section 59, each as a standalone set or together with the response, kept within the scope of the specification as filed and reconciled with one another.

  • Novelty and inventive step. Section 2(1)(j) and Section 2(1)(ja), with D1, D2 and every cited document distinguished feature by feature.
  • Non-patentable subject matter. Section 3(d), Section 3(k) and the rest of Section 3, argued on the technical contribution.
  • Sufficiency and clarity. Section 10(4) and Section 10(5): disclosure, support, unity and definiteness.
  • Formal objections. Section 8, Form 3, drawings and abstract, each closed out.

Patent Form 3

The Section 8 statement and undertaking, filing-ready.

Section 8 asks the applicant to keep the Controller informed of every corresponding application filed outside India. The family changes; the form must follow. This agent reads the WIPO and PATENTSCOPE status reports and the client's own chain, and prepares the Form 3 with every family member listed and its status current.

Twenty-five fields. One persona for each.

A pharmaceutical claim set and a telecommunications claim set are not written by the same mind. Every drafter and responder in the suite writes as a registered patent attorney with twenty-five years' practice in the invention's own field.
